ARISE+ Indonesia has provided draft documentation that the Komite Anti-Dumping Indonesia (KADI) requires to initiate and conduct countervailing (anti-subsidy) investigations.

Countervailing investigations may result in countervailing duties being imposed against imports subsidised by the governments of the exporting countries and where such imports cause injury to a domestic industry in Indonesia producing a like product. The comprehensive array of documentation includes, for instance, the application questionnaire (that domestic industry has to complete to lodge an application) the respondents questionnaires (that foreign producers and the foreign governments have to complete to prove the effect of any subsidy programmes) and a manual KADI can use to verify foreign producers’ and governments’ responses. The documentation also includes the technical submissions that the investigating officers must prepare for KADI to make preliminary and final determinations, and the preliminary and final public reports.

ARISE+ Indonesia has also prepared very detailed standard operating procedures (SOPs) for use in countervailing investigations. These SOPs set out every step to be undertaken in an investigation, from receipt of the application to the implementation of the final measure. The SOPs provide KADI with details of the timelines in the investigation, where the relevant legislation can be found, and indicates whom the responsibility for each step rests with. The SOPs will be a valuable case management tool for KADI, as KADI management will be able to see immediately the progress of each investigation, and when and what next steps should be taken.

The SOP’s and documents that have been drafted will capacitate KADI to undertake countervailing investigations to protect Indonesian industry against injury caused by subsidised imports. Moreover, this will provide Indonesian industry with a layer of World Trade Organization-sanctioned protection that can be used against injurious imports.

ARISE+ Indonesia will follow up on this activity by providing training on the use of the SOPs and the countervailing documents, as well as technical aspects of countervailing investigations. This will further capacitate the Ministry of Trade in protecting Indonesian industry against unfair imports.

ARISE+ Indonesia is a technical support programme that aims to strengthen the capacity of government institutions and stakeholders on a wide range of areas within international trade, competitiveness, and business environment. It is coordinated by BAPPENAS (the Ministry of National Development Planning), together with the Ministry of Trade and other relevant ministries, government agencies and stakeholders that have a direct interest in the areas covered by the programme. The programme lasts four years and is supported by the European Union.
